How to resolve an eBay Scam buyer?

I sold a very older model Cannon notebook style scanner. No longer made from 2002. I stated in the auction that it appears in Mint condition which is true. I also noted that I never used it, it was missing software, and the USB plug was missing. It was given to me. Again, I noted I never used it so I had no clue if it worked. I noted it was not dropped and was never exposed to water. I wrote FRAGILE all over the box and wrapped it well in in bubble wrap. I asked to buy packing peanuts and the lady that worked at the post office held up arms full of plastic bags that a customer left and told me this will save me money. She helped me pack it and packed the sides well and to the top. I mentioned it seemed loose and told me it was fine and would move with packing peanuts too. So, I took her word and mailed it. I got an email from the buyer stating it scanned green and he contacted Cannon and said if it is moved around it will cause that. I knew it was fragile so I made sure it was written all over the box, I took the ladies word at the post office that it would be handled with cared and the packaging was sufficient. Again, I stated in the auction it has never been used and there was no software or cables. So, that shows I did not know the working condition. I listed it for $5.00 due to the lack of equipment and not being used before. The seller is stated I had a small amount of bubble wrap around it. I had a lot and it was taped too. He also said I had a few a plastic shopping bags placed on top. Which was not true. There was a lot packed from top to sides. So, he is blaming me from what Cannon told him it was moved around caused the problem. He paid like $40 for something I stated was not used so who knows if it worked. I guess I feel I do not need to refund the money. I would not pay $40 for something if I was not guaranteed it worked or not. Sometimes I wonder about people. He could go to Best Buy and buy a new one for $50 or maybe less. I am just really discouraged. Any ideas before I contact eBay?

As long as it was stated in the listing that there was no guarantee of condition or operation, and you were selling it as is, without any warranties (which it kind of sounds like you did in a way from what you stated, but would need to see the actual listing), you can state that in your response as well as how you actually packaged it to refute how he said it was packaged. As for the Fragile on the box, that doesn't usually help too much on how it's actually handled, and scanners usually have a lock down mechanism of some kind that should be used whenever it is moved or transported to prevent problems, though that's not to say that it may have already had a problem anyhow. Just present your case with as much detailed information about it as possible, using your listing as proof of stating the unknown condition and operation of the unit when sold and that it was purchased by the buyer with full knowledge upfront that it was missing several components and the operational status of it was unknown and you did not express any guarantees or warranties at the time of sale.   3. I buy a lot from ebay. Contact them IMMEDIATELY and explain it to them that you THINK that the person is a SCAM BUYER. They will have a record if HE is because they note all transactions. Do the first move. EBAY will evaluate it. Usually, the buyer is protected unless EBAY has had complaints int he past about this person. Secondly, EBAY will try to resolve by maing a price adjustment.
  4. Check his feedback! If he has some negative comments, or has some that have been deleted, he's a scammer. If you clearly stated the condition, it's "buyer beware".
